Family Tree Wellness, in accordance with the rules, laws, and regulations set by the
New Jersey Division of Developmental Disabilities (DDD). The policy aims to ensure that every individual is treated with dignity, respect, and in a manner that promotes personal growth, independence, and self-determination.
ScopeThis policy applies to all individuals receiving services through
Family Tree Wellness and all employees, caregivers, volunteers, and contractors providing care or support services to these individuals.
Client RightsAs a client receiving services through
Family Tree Wellness you have the right to:
1. Dignity and Respect- Be treated with dignity, respect, and consideration for your personal beliefs, culture, and preferences.
- Expect that your personal dignity will be maintained at all times.
2. Freedom from Abuse, Neglect, and Exploitation- Be free from all forms of abuse, neglect, exploitation, and retaliation.
- Report any mistreatment without fear of retribution.
3. Personal Privacy and Confidentiality- Have your personal information treated with confidentiality according to applicable laws (e.g., HIPAA), and to access your own records upon request.
- Expect that your privacy will be respected in your personal living space and during the delivery of services.
4. Individualized Support- Receive individualized services and supports based on your Individualized Service Plan (ISP), developed in partnership with you and your support team.
- Be involved in all decisions about your care, including choosing service providers, and changing or discontinuing services.
5. Informed Choice and Consent- Be provided with clear, understandable information regarding services, treatments, and choices available to you so that you can make informed decisions.
- Have the right to refuse services or withdraw consent at any time without penalty, unless it conflicts with legal or safety concerns.
6. Community Participation- Engage in community activities and social interactions that are meaningful to you.
- Be supported in pursuing employment, recreational activities, and relationships that help you integrate into the community.
7. Right to Appeal and Grievance- File a grievance or complaint if you are dissatisfied with the services provided or feel your rights are being violated.
- Expect a timely response to your grievance, including a fair hearing or appeal process, as outlined by DDD regulations.
8. Access to Legal Representation- Have access to legal representation and advocacy services, including the right to appoint a representative or guardian if necessary.
- Be informed of your legal rights regarding guardianship or representation.
9. Freedom of Expression- Exercise your freedom of speech and communicate your preferences, feelings, and needs.
- Participate in decision-making about the rules and activities of your living environment.
10. Health, Safety, and Well-being- Receive care that promotes your health and well-being, including proper nutrition, medical care, and safe living conditions.
- Be informed about your healthcare options and have the opportunity to make decisions regarding your healthcare.
11. Financial Freedom- Manage your personal funds or receive assistance in managing them, as agreed upon in your service plan.
- Be free from financial exploitation, and expect accountability for the management of your financial resources if under fiduciary care.
12. Religious and Cultural Freedom- Practice your religion and observe your cultural traditions without interference or discrimination.
13. Right to Refuse Employment- You have the right to decline participation in employment without negative consequences if employment is not part of your service plan or personal goals.
Client ResponsibilitiesAs a client receiving services through
Family Tree Wellness, you are expected to:
1. Respect for Others- Treat all employees, caregivers, and other individuals in the program with respect and courtesy.
- Respect the rights and dignity of others sharing your living environment or participating in services with you.
2. Participation in Your Service Plan- Actively participate in the development and implementation of your Individualized Service Plan (ISP).
- Provide input about your needs, preferences, and goals so your services can be tailored to support your independence and well-being.
3. Communication- Communicate your preferences, feelings, and needs clearly to your support staff.
- Inform your service providers promptly if you experience any dissatisfaction with your services.
4. Health and Safety- Take steps to maintain your health, including following medical recommendations and keeping appointments with healthcare providers, as outlined in your service plan.
- Respect safety protocols and avoid behaviors that could endanger yourself or others.
5. Financial Responsibilities- Manage your financial resources responsibly or work with your designated representative to ensure your funds are used appropriately for your care and support.
- Provide accurate information regarding your financial situation to ensure eligibility for programs or services.
6. Compliance with Rules- Follow the rules and guidelines established in your residential setting or service environment, provided they do not infringe upon your rights.
- Respect the property of others and adhere to any community agreements.
7. Cooperate with Your Support Team- Work collaboratively with your caregivers, support coordinators, and family members to ensure the success of your service plan.
- Attend scheduled meetings and appointments to keep your services active and aligned with your goals.
Reporting ViolationsIf you feel that any of your rights have been violated, you can:
- Report the violation to your service coordinator, caregiver, or any Family Tree Wellness representative.
- File a formal complaint with the Division of Developmental Disabilities (DDD), which can be done through the DDD’s complaint process.
Policy Review and UpdatesThis policy is subject to review and revisions to remain in compliance with the laws and regulations of the
New Jersey Division of Developmental Disabilities (DDD). Updates will be communicated to clients and staff as necessary.

Family Tree Wellness, you acknowledge that you have received a copy of this
Client Rights and Responsibilities Policy and understand your rights and obligations.
